2.Acceptance of these Terms

By accessing our website, creating an account, purchasing a subscription or using any of our apps or services, you agree to these Terms & Conditions and our Privacy Policy.

If you do not agree, please do not use our services.

You must be legally capable of entering into a binding agreement to make purchases or enter into paid subscriptions. If you are under 18, you may use our services only where permitted by law and with the involvement or consent of a parent or legal guardian where required.

3.Our products and services

Her Life Lab provides digital tools intended to help users organise aspects of everyday life, motherhood, family responsibilities, celebrations and seasonal planning.

Our products may include:

  • UltiMom: A family and personal organisation app that may include family profiles, calendars, reminders, party planning, shopping lists, personal notes, memory keeping, document storage and other organisation features.
  • MerryMagic: A Christmas planning app that may include holiday checklists, gift planning, event organisation and Secret Santa tools.

We may add, change, improve, suspend or discontinue features from time to time. Where a change materially affects a paid service, we will take reasonable steps to communicate the change where appropriate and as required by law.

Feature availability may vary depending on your subscription, account type, device, location or the stage of product development.

4.Accounts and account security

Some features may require you to create an account.

You agree to provide information that is accurate and to keep it reasonably up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, except where applicable law provides otherwise.

You must notify us promptly if you suspect unauthorised access to your account.

You may not:

  • Access another person’s account without permission.
  • Impersonate another person or provide misleading account information.
  • Attempt to bypass security measures or access restricted systems.
  • Use our services to distribute malicious software, commit fraud or carry out unlawful activity.

We may restrict or suspend access where reasonably necessary to protect users, investigate suspected misuse, comply with law or protect our services. Where appropriate and legally permitted, we will provide notice and an opportunity to address the issue.

5.Information you add to our apps

Our services may allow you to enter, upload, store or organise personal information, including family details, children’s profiles, photographs, calendar entries, notes, memories, health-related information, emergency details, policy numbers and other documents.

You remain responsible for the information you choose to provide and for ensuring that you have the necessary rights and permissions to provide it.

Please do not upload information about another person unless you have a lawful basis to do so. If you add information about a child, you must be their parent or legal guardian or otherwise have appropriate authority and comply with applicable law.

You should exercise care when entering sensitive information. Only provide information that is reasonably necessary for your intended use of the service.

Our apps are organisation tools. They are not a substitute for secure specialist systems designed specifically for medical records, financial accounts, identity documents or other highly sensitive records.

6.Children’s information

Parents and guardians may use our services to organise information about their children.

You are responsible for ensuring that information about your children is accurate, appropriate and lawfully provided. You should avoid including unnecessary identifying information or details that could place a child at risk if disclosed.

We do not intend our services to be used by children to independently create accounts or submit personal information without appropriate adult involvement where required by law.

Our handling of personal information, including children’s information, is explained in our Privacy Policy.

7.Personal notes, reminders and stored documents

Some features may help you keep reminders, notes, family memories, emergency information, wishes, policy numbers or details of service providers.

These features are provided for convenience and organisation. You remain responsible for checking that entries are accurate and up to date.

Do not rely on a reminder, calendar entry, notification or stored document as your only safeguard for an important deadline, medical matter, emergency, financial obligation or legal responsibility.

You should retain independent copies of important documents and information. We do not guarantee that information will always be available, synchronised, recoverable or retained indefinitely.

Any “emergency file”, “wishes” feature or similar tool is an organisational aid only. It does not itself create a will, power of attorney, medical directive, funeral instruction, insurance arrangement or other legally binding document. Obtain professional advice where necessary and make sure relevant documents are validly executed and accessible to the appropriate people.

8.Acceptable use

You agree to use our website, apps and services lawfully and respectfully.

You must not:

  • Violate any applicable law or another person’s rights.
  • Upload content that is unlawful, fraudulent, defamatory, threatening or abusive.
  • Access, interfere with or disrupt our systems without authorisation.
  • Attempt to reverse engineer, copy, resell or commercially exploit our software except where permitted by law or with our written permission.
  • Use our services to send spam or conduct unauthorised marketing.
  • Upload content containing malware or other harmful code.
  • Use the services in a way that compromises another user’s privacy or security.

We may take reasonable action in response to suspected violations, including restricting access where justified.

9.Intellectual property

Unless otherwise indicated, the Her Life Lab name, branding, logos, designs, website content, original text, graphics and software associated with our services belong to Her Life Lab or are used under appropriate permission or licence.

You may use our services for their intended personal purposes, subject to these Terms.

You may not reproduce, adapt, distribute, publicly display, sell or commercially exploit our intellectual property without prior written permission, except where permitted by applicable law.

You retain any rights you hold in the content you submit. You grant us only the limited rights reasonably necessary to host, process, display, back up and otherwise use that content to provide and maintain the features you choose to use, comply with law and protect our services.

10.Subscriptions, prices and payments

We offer three UltiMom plans: Free, Monthly (R89.99 or $4.99) and Annual (R989.99 or $54.99). Prices may change. The final price is shown at checkout in your local currency.

Before completing a purchase, the applicable price, billing frequency, included features and any material subscription conditions should be displayed to you.

Unless clearly stated otherwise at checkout:

  • Prices will be displayed in the currency specified at the point of purchase.
  • A subscription may renew automatically only where this is clearly disclosed and lawfully authorised.
  • You are responsible for checking the terms of the selected plan before purchasing.
  • Access to paid features may depend on successful payment.

All payments are charged to your Apple App Store or Google Play Store account. UltiMom does not charge your card directly.

Monthly and Annual plans renew automatically unless cancelled at least 24 hours before the end of the current billing period.

If a payment fails, we may notify you and, where appropriate, restrict paid features until the payment issue is resolved, subject to applicable law and the terms disclosed at purchase.

We will not impose undisclosed charges or materially change a paid subscription’s terms contrary to applicable law.

11.Cancellation, refunds and consumer rights

Store subscriptions are cancelled in your App Store or Google Play Store settings. You can still email us for help.

Deleting the app does NOT cancel your subscription. You must cancel in your phone's store settings.

Premium features will continue to work until the end of your paid period. Your saved records and data will be kept.

The effective cancellation date, access to paid features after cancellation and any applicable notice period will be governed by the plan terms disclosed to you and applicable South African law.

Cancellation of a recurring subscription generally stops future renewals; it does not automatically mean that a payment already made will be refunded.

All store purchases are refunded by Apple or Google according to their policies. This does not affect your rights under South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded or limited. Where a statutory cooling-off period, refund or cancellation right applies, that right will take precedence over any inconsistent term in these Terms.

Where you purchase through a third-party platform, its cancellation and refund process may also apply, without removing any rights you have under applicable law.

12.Third-party services and links

Our website and apps may rely on or link to third-party services, including hosting providers, authentication services, payment processors, analytics tools or external websites.

Those services may operate under their own terms and privacy policies. We are not responsible for independent third-party websites or services that we do not control. This does not exclude any responsibility that applicable law places on us.

Where a third party processes personal information on our behalf, our Privacy Policy explains the general approach we take to such processing.

13.Availability, updates and backups

We aim to provide useful and reliable services, but we do not guarantee uninterrupted or error-free access.

Access may occasionally be affected by maintenance, technical issues, internet connectivity, device compatibility, third-party service interruptions or circumstances beyond our reasonable control.

Features may be updated, modified or discontinued as our products develop. We will handle material changes to paid services in accordance with applicable law and any commitments made to you.

You are encouraged to retain independent copies of important information and documents. We do not guarantee permanent storage or recovery of any content.

14.No professional advice

Our apps provide organisation and planning tools. Unless we expressly state otherwise, they do not provide medical, legal, financial, psychological, insurance or other regulated professional advice.

Any health-related fields, reminders or notes are for your own organisation and are not a diagnosis, treatment recommendation or substitute for advice from a qualified professional.

Any budgeting, savings, gift-planning, emergency or document features are informational and organisational tools only. You are responsible for decisions you make based on information stored in or generated through the services.

15.Disclaimers and limitation of liability

To the extent permitted by applicable law, our services are provided on an “as available” basis. We do not warrant that the services will always meet every user’s needs, remain available without interruption or be free from every error.

Nothing in these Terms excludes, restricts or limits liability where such exclusion, restriction or limitation is prohibited by law.

Subject to that restriction, we will not be liable for losses arising from matters beyond our reasonable control, a user’s failure to maintain independent copies of important information, inaccurate information entered by a user, or reliance on an app reminder or stored entry as the sole safeguard for an important matter.

Where the law permits a limitation of liability, our liability will be limited to the extent reasonably permitted by law, taking account of the nature of the service and the circumstances of the claim.

Nothing in this section removes rights or remedies available to consumers under applicable South African legislation.

16.Suspension and termination

You may stop using our services at any time. Where account deletion is available, you may use the provided process or contact us for assistance.

We may suspend or terminate access where reasonably necessary because of a serious breach of these Terms, suspected fraud, security risks, legal requirements or the discontinuation of a service.

Where appropriate and legally permitted, we will give reasonable notice and explain any available steps to resolve the issue.

Termination does not remove rights or obligations that arose before termination, including any payment obligations lawfully due or statutory rights you retain.

Our Privacy Policy explains what happens to personal information after account closure or a deletion request.

17.Changes to these Terms

We may update these Terms as our products, business or legal obligations change.

The latest version will be published on our website with its updated effective date. Where a change materially affects users or an existing paid service, we will provide notice where reasonably appropriate or required by law.

Continued use after an updated version takes effect will be subject to the revised Terms to the extent permitted by law. If you do not agree with a material change, you may stop using the affected service and exercise any cancellation rights available to you.

18.Privacy and personal information

Our collection and use of personal information are governed by our Privacy Policy, which forms part of these Terms.

We aim to handle personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law.

19.Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a South African court or other competent forum with jurisdiction, subject to applicable consumer protection legislation and any mandatory legal rights.

Nothing in these Terms prevents you from approaching a relevant regulator, consumer body or competent authority where permitted by law.
